Terms of Service

These Terms of Service apply to your use of the Earth Discoveries website and to purchases made from Earth Discoveries Limited.

By accessing our website or purchasing from us, you agree to these terms.

About Earth Discoveries

Earth Discoveries Limited is a New Zealand business providing fossil, mineral and specimen-based excavation kits, educational products, display products and related items.

Throughout these terms, “Earth Discoveries”, “we”, “us” and “our” refer to Earth Discoveries Limited.

Online Store

By purchasing from our website, you confirm that the information you provide during checkout is accurate and complete.

You must not use our products or website for any unlawful purpose or in a way that violates applicable laws or regulations.

We reserve the right to refuse or cancel an order where reasonably necessary, including where we believe an order has been placed fraudulently, a product is unavailable, or an obvious pricing or listing error has occurred.

If we cancel an order after payment has been received, the applicable amount will be refunded.

Products & Natural Specimens

Many Earth Discoveries products contain genuine fossils, minerals, rocks or other natural specimens.

Natural specimens are inherently unique. Their size, colour, shape, texture, completeness and overall appearance may vary from photographs and examples displayed on our website.

Product photographs are intended to provide a representative example and do not guarantee that you will receive an identical specimen unless the listing specifically states that the exact specimen pictured is being sold.

Natural variation is not considered a product fault.

Excavation Kits

Our excavation kits are designed as hands-on educational and discovery products.

Please follow any instructions, age recommendations and safety information supplied with the product.

Children should be appropriately supervised when using excavation kits, particularly where kits contain small specimens or excavation tools.

Excavation may create small amounts of dust or loose material. We recommend using the products in a suitable area and following the instructions provided.

Product Information

We make reasonable efforts to ensure that product descriptions, educational information, specimen identification, geological ages and other information provided with our products and on our website are accurate.

However, information relating to natural history, fossils, geology and specimen provenance may sometimes be based on supplier information, scientific interpretation or the information reasonably available to us.

Educational information provided by Earth Discoveries is intended for general educational purposes.

Pricing & Payment

Prices displayed on our website are shown in New Zealand dollars (NZD) unless otherwise stated.

Prices, promotions and product availability may change from time to time.

Payment must be successfully completed before an order is processed unless another arrangement has been agreed with us.

Discount codes and promotional offers may be subject to additional conditions, expiry dates, product restrictions or availability. Unless otherwise stated, promotional offers cannot be exchanged for cash.

Orders are shipped from Gisborne, New Zealand.

Shipping costs and available delivery options are displayed during checkout.

Delivery estimates are estimates only. Once an order has been handed to a shipping or courier provider, delays may occur that are outside our reasonable control.

Customers are responsible for providing an accurate delivery address when placing an order.

Further information is available in our Shipping & Returns policy.

Returns & Refunds

Returns, refunds, damaged products and incorrect orders are handled in accordance with our Returns & Refund Policy.

Nothing in these terms limits any rights or remedies available to you under the New Zealand Consumer Guarantees Act 1993 or other applicable consumer law.

To the extent permitted by New Zealand law, Earth Discoveries Limited will not be liable for indirect or consequential loss arising from the use of our website or products.

Nothing in these terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot legally be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.
